The ABA Standing Committee on Ethics and Professional Responsibility issued Formal Opinion 512 on July 29, 2024. It ties a lawyer's use of generative AI to duties the Model Rules already set: competence (Rule 1.1), confidentiality (Rule 1.6), communication with clients (Rule 1.4), candor and meritorious claims (Rules 3.1 and 3.3), supervision of lawyers and staff (Rules 5.1 and 5.3) and reasonable fees (Rule 1.5).
In practice the opinion asks lawyers to understand a tool well enough to use it competently, to assess the risk of disclosing client information before entering it into a tool (and to get informed client consent where that risk requires it), to review outputs rather than rely on them, and to bill fairly for work the tool sped up.
ABA opinions are advisory. The rules and bar guidance of each state where a lawyer is admitted govern their conduct.
